1. Agreement to Terms

By registering as a business on TasteTester, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our service.

2. Service Description

TasteTester provides a mystery shopping platform connecting businesses with customers who provide detailed feedback in exchange for promotional offers. Our service includes:

• Mystery shopper recruitment and management
• Survey creation and distribution
• Analytics and reporting tools
• Refund processing and administration

3. Business Obligations

As a business user, you agree to:

• Provide accurate business information and keep it updated
• Honor all published offers and promotions
• Maintain quality standards in your products and services
• Respond professionally to customer feedback
• Not discriminate against mystery shoppers

4. Payment and Refunds

You understand and agree that:

• TasteTester processes refunds to shoppers on your behalf
• You will be invoiced monthly for all approved refunds plus a 5% platform fee
• Payment is due within 14 days of invoice date
• Late payments may result in service suspension
• All transactions are processed securely through Stripe

5. Subscription Plans

TasteTester offers subscription tiers with varying features. You agree that:

• Subscription fees are non-refundable
• You may upgrade or downgrade at any time
• Changes take effect at the next billing cycle
• Cancellation requires 30 days notice

6. Data and Privacy

We take data protection seriously:

• Customer survey data is confidential and for your business use only
• You may not share or sell customer data to third parties
• We comply with GDPR and data protection regulations
• Customer information is encrypted and securely stored
• You own your business data and may export it at any time

7. Intellectual Property

You retain ownership of your business name, logo, and content. By using TasteTester, you grant us a license to display this content on our platform for the purpose of promoting your offers to shoppers.

8. Prohibited Activities

You may not:

• Create fake reviews or manipulate feedback
• Attempt to identify mystery shoppers
• Refuse service to customers you suspect are mystery shoppers
• Use the platform for fraudulent purposes
• Violate any applicable laws or regulations

9. Termination

We reserve the right to suspend or terminate your account for violation of these terms, non-payment, or fraudulent activity. Upon termination, you remain responsible for any outstanding fees or refunds owed.

10. Limitation of Liability

TasteTester is not responsible for the quality of feedback received, disputes with customers, or any indirect damages arising from use of our service. Our liability is limited to the amount paid for our service in the preceding 12 months.

11. Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration in accordance with the laws of Ireland. You waive any right to participate in class-action lawsuits.

12. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of significant changes via email.
